Host George Stephanopoulos asked, “Does President Trump have the ability, have the authority to declare a national emergency and have the military build his wall?”


Smith said, “Well, unfortunately, the short answer is yes. There is a provision in the law that says the president can declare an emergency. It’s been done a number of times, but primarily it’s been done to build facilities in Afghanistan and Iraq.

He goes on to admit that the only way to stop Trump on this is to challenge in court his declaration of emergency. That will be where this fight gets really interesting but they know they'll lose in the end. Best they can hope for is another leftist judge temporarily imposing a delay.

While Republican lawmakers often slammed President Barack Obama's executive orders, they have had little such criticism of President Donald Trump's use of those orders, according to Roll Call.

Executive orders bypass Congress, and Rep. Tom Cole, R-Okla., criticized Obama for "temper tantrum-like behavior" when he used them, Roll Call's reports.

"Most of these orders relate right now to the executive branch, and I don't think he's trying to legislate through them," said Cole. "If our Democratic friends think they'll do what we did—they'll take him to court and they'll win some and they'll lose some."

Rep. Jason Chaffetz, R-Utah, said of Obama's orders: "It is behavior that undermines, and will ultimately erode, the foundation of our democracy and our freedom."

This President has already played the "national emergency card" to place higher tariffs on aluminium and steel imports on such treacherous countries as Canada who are secretly conspiring to subvert the economy of her southern neighbour!

What's to stop this President from implementing his entire agenda under the guise of one "national emergency" after another - rendering the Legislative Branch of government redundant?

Where are those same conservatives who were complaining just few years ago that that by relying on "executive orders," the Obama Administration "undermines, and will ultimately erode, the foundation of our democracy and our freedom" - how quick they forget!
