Fighting dirty, a roadmap for Dems to cement power

Senate Majority Leader Mitch McConnell’s stonewalling of President Obama’s court nominee, Merrick Garland, was the beginning of a drama that spurred Democrats’ latest disillusionment with the Supreme Court. President Trump’s appointment of two young — well, more like “young” — conservative judges, Neil Gorsuch and Brett Kavanaugh, seems to have unleashed an urgent strain of thought in some liberal circles: The court is broken and it needs fixing.

The solution? For some, it’s court-packing.

You’ve likely heard of the concept in history books, referring to a time back in the 1930s when President Franklin Roosevelt was fed up with the Supreme Court’s continual rejection of some elements of his New Deal plan. To get around the impasse, he proposed the addition of up to six new justices to the court in an effort to shift the ideological balance to the more liberal end of the spectrum.

Roosevelt failed to pack the highest court, but his novel little idea has attracted renewed interest in the Trump era. Political scientist David Faris wrote a book, published this spring, called “It’s Time To Fight Dirty,” a kind of highbrow manual for rat****ing one’s way to institutional change. Faris told me the idea for the book came in the wake of the 2016 election, when he was filled with rage. “The whole idea was born out of bleakness,” he said. “It unleashed some creativity.”

The book is full of strategies Democrats could use to regain power, like making Washington, D.C., and Puerto Rico states and expanding membership in the House of Representatives (a topic recently taken up by the editorial board of The New York Times). But one chapter in which Faris outlines a plan to pack the Supreme Court and instate term limits for the justices has gotten perhaps the most attention. Faris credits an organization called Fix The Court for coming up with some of the specifics of the plan he outlines in the book: a constitutional amendment revoking lifetime tenure for the federal judiciary, a law that allows the president to appoint a justice in the first and third year of his term of office and that imposes 18-year term limits on justices, and a restructuring that increases the number of justices on the Supreme Court to 11 or 13, “depending on how many justices President Trump ends up appointing.”

Seems like this could be a plan to cement Democrat power, fighting dirty:

1. Expand membership in house (reduces effect and power of gerrymandering, as well as reducing influence of low population states in electoral college, if paired up with a change in electoral college votes).

2. Add as many blue states as possible (cement power in the senate)

3. Pack the courts

4. Maybe also gerrymander as much as they can get away with once in power (tit for tat with Republicians).

5. Shut down as many polling stations as possible in communities with lots of retirees which tend to vote more heavily for Republicians (similar to how Republicians are doing it in poor and minority communities).

Would such moves trigger secession of red states and possible civil war? Maybe this time let the states that want to leave the union, leave it? It looks like fighting dirty is the direction our politics is heading. I believe both sides will do whatever it takes to cement power, abandon all norms. If one side doesn't do it when in power, they'd be fools, it would seem.

The truth is, Republicians are and have been a minority party for a number of years (losing popular vote in 2 presidential races, being beat by overall number of Dem votes in house races pretty regularly), so once Dems start "fighting dirty", it will be hard to stop their cementing of power.

You mean a civil war? Nothing I listed in the roadmap is unconstitutional. Any party can enact the roadmap when they control Congress and the presidency (or at the state level, state legislatures).

I find it impossible to believe that the pampered, feminized, sissified, Starbucks drinking, skinny jeans wearing, I need a safe space, gun hating, liberal arts degree having millennial males are going to take up arms and fight pitched battles in open fields like it's the Battle of Shiloh or Gettysburg. And let be clear. The pink haired, socialist, man hating, #metoo women will be no where to found if actual civil war breaks out.

they'll manage to worm their way into power, either through politics or pop culture - look at the incredible damage done to this once great country by the fifth column led by the likes of tom hayden and jane fonda


it's satisfying to know that the traitor hayden had to stand before God and answer for his crimes of facilitating the murders of millions of southeast asians after 1975

I agree they may gain some measure of influence but at some point if war breaks out someone has to fight, some has to pull the trigger, someone has to bleed on the battlefield. Is the typical SJW/Internet warrior going to do that?

Those guys are cowards. They only start brawls because they know the other side is not going to escalate it too much because the media and police are around. Plus those antifa sissies will pee in their pants if they were forced to fight an armed enemy in a pitched battle.

A bunch of college students is in no way the bulk of the Left. I figure a lot of those unions would be more than happy to do exactly what you say the Right would do- and what makes them so much more militant than others? Are Right wing people born with a gun on their hip?

Regardless, another civil war in America would hardly be anything like the first. It'd be more like a 'cold war' with states dividing all through rather than North and South. And unfortunately for the Reps the Dems have all the more populated areas and people easily motivated to violence.

Which unions are you referring to? Union membership is down across the board.

Regardless, another civil war in America would hardly be anything like the first. It'd be more like a 'cold war' with states dividing all through rather than North and South.
This is not a civil WAR then. War means actual physical combat with both sides armed with weapons. Even the real "cold war" had actual battles in various places around the world (SE Asia, South America, Cuba, etc). How exactly are states going to divide? Even in California a large minority are not leftists. In the recent gubernatorial election the a no-name GOP candidate got just under 40% of the vote.

And unfortunately for the Reps the Dems have all the more populated areas and people easily motivated to violence.
You mean like San Francisco, Portland, and Seattle, all bastions of leftists and SJW? These places are not exactly havens for gun rights and gun ownership. In fact in San Francisco there is not one gun store left, the last one closing in 2015.

The typical liberal is not an 'SJW'. I know more Democrats who not only own guns but carry them around with them pretty religiously. The most I see with Republicans when it comes to guns are in brief periods of 'virtue signalling' where the tote them on their hip after a school shooting or something and then revert back to being just like anyone else.

The media isn't a very good indicator of much of anything, whether it's CNN or Fox. Everybody has a misconception about guns and saying that the Reps would stomp the Dems simply because they find every little attempt at curbing gun violence 'unconstitutional' is just ridiculous, especially being that a lot of guns used for crime are rather stolen from 'law abiding citizens'.
What a heavy price to pay to avoid simple gun control measures- get shot by guns that were originally bought for self defense.

"The Berean" has conveniently overlooked the fact that those "pampered, feminized, sissified, Starbucks drinking, skinny jeans wearing... pink haired, socialist, man hating" Democrats just won a record 40 seat swing in the House and 7 governorships!

The Senate will be much more exposed to a Democratic takeover in 2020 - the only question facing Republicans is whether to "jump ship" or "go down with all hands!"
