Despite protests from some governors, President Donald Trump has the legal authority to send active-duty military personnel to states to help put down violent demonstrations, law experts told The Washington Post on Tuesday.

Even though the Posse Comitatus Act forbids the domestic use of military for law enforcement purposes without specific congressional authorization, University of Texas Law School Prof. Stephen Vladeck said the Insurrection Act, gives the president the right to do so under certain circumstances, especially if state authorities are unable to give their residents the protection of law.


Although its modern use is rare, the Insurrection Act has been invoked as recently as 1992 during riots in California over the beating by Los Angeles policemen of unarmed motorist Rodney King, according to a Congressional Research Service report.

In that case, however, the state’s governor requested it.

Vladeck pointed out other instances in which the act was used, included during the 1950s, when President Dwight D. Eisenhower sent the Army into Little Rock to desegregate its schools.

Retired West Point law Prof. Gary Solis agreed that, even if state and local officials likely “would fight tooth and nail to keep federal troops out,” the Insurrection Act “does give the executive extraordinarily broad power to assemble federal troops to restore order in the various states.”

The leaders of the US military are well aware that during an election year, this President is more than capable of using them as pawns to provide him with any advantage that would result in his re-election!

The last thing the US military wants is to be seen removing peaceful protesters exercising their 1st Amendment Rights that they have swore to uphold, forever depicting them as the 2020 equivalent of the Chinese Peoples Liberation Army clearance of protesters from Tiananmen Square in 1989?

If the clearance of peaceful protesters exercising their 1st Amendment constitutional rights in Layette Park across from the White House was any example, the last thing even Republican governors want is this President's heavy handed use of military force to create yet another "photo-op" a their expense!

1) The current protests in virtually every city in America are based on the fact that "black" citizens feel they have been "oppressed" for over 400 years and under this President the gap between them and "whites" has actually widened!

2) Protesters are not "extremist terrorists" - protests during the day have been remarkably peaceful, its the opportunists, looters and extremist elements that tend to come out at night that are the problem!

"..... the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

3) The constitutional right of citizens to protest against their government is guaranteed under the 1st Amendment which this President, his Administration and members of the US military have all sworn to uphold!

“If a city or state refuses to take the actions that are necessary to defend the life and property of their residents, then I will deploy the United States military and quickly solve the problem for them,” Trump said during a Rose Garden address as cities across the country grappled with property destruction, looting and violent police clashes in the week since the death of George Floyd in Minneapolis.

Legal experts say the president does indeed have the authority under the Insurrection Act of 1807 to dispatch the military in states that are unable to put down an insurrection or are defying federal law.

In the last half-century, presidents have sent the military to Southern states to ensure desegregation of schools and to protect civil rights in the 1950s and 1960s, and to Los Angeles after the California governor sought federal help during the 1992 riots.
