So assuming that we started on it today, most experts are saying the wall will take a decade or more to build. So in five years, the wall will not have stopped a single shipment of drugs, a single caravan, a single rapist, a single people smuggler. Why is this an emergency again?

I even see things getting worse over that period as building the wall will create a network of roads and infrastructure to support it first which will be a boon to smugglers.

And, I'm sure land owners in Texas are just lining up to give their land up to the federal government. Well, I'm sure they'll be well armed. Funny how certain people who support a federal land grab on the border supported the Bundy's against the BLM.

Why is this an emergency again?

It's not and Trump even admitted as much:
“I could do the wall over a longer period of time,” Mr Trump said in response. “I didn’t need to do this, but I’d rather do it much faster.”

Or, one could say that we have purchased 5 walls already since Obama was elected, and all we have to show for it is untold rapes and murders instead of a wall.

On 15 Feb, Congress passed a bill setting the specific amount of funds that may be spent on a border wall and sent it to President Trump who signed it. Congress acted according to its Constitutional authorities.

On 15 Feb, President Trump declared a state of emergency with the specific intent of defeating the above limits, thus violating the checks and balances built into the Constitution by the power of the purse.

That the Emergency Powers Act may have been poorly written and technically construed to say that Trump has this authority is irrelevant. The authority of all federal law derives from the Constitution and no federal law or bill less than an amendment can override the Constitution.

This action puts President Trump in violation of his oath of office. And any Republican Congressman who supports his action when the Congress acts to correct the situation will be in violation of their oaths as well.

I would agree but for what it was intended to do it is not in violation, it is the length that Trump and others are stretching it to that is the problem. Which is why it has not been a problem before now. At a minimum, it needs to be tightened up to ensure it is not abused like this again.

Again, I agree. It is just that until now it has not been used for such applications and thus a challenge has not been raised.

An interesting point I heard yesterday is that the Emergency Powers Act was intended to impose restrictions on the President. Which is why it has several reporting requirements and the provision for Congress to cancel an emergency declaration by a simple majority vote that the leadership has to allow. The problem was nobody seems to have thought about the problem of overcoming a veto.

I think every major episode involving the Wall and the bad guys in the North had said bad guys getting around it somehow, from climbing it to going underneath.
